When do you report an accident, when don’t you, and what are the consequences? Below are some valuable guidelines to help you know what to do if you get in a collision.

Reporting an Accident: No injuries and damages are within your province’s threshold

Police Reporting: Each province sets a dollar value for estimated damages that will determine if you need to involve the police. In Alberta and Ontario, for example, the threshold is $Two,000. What’s this mean? You are not required to report an accident to the police if the total harm is less than that outlined by the province. This limit includes the harm to both vehicles.

  • The limit in Ontario and Alberta used to be $1,000; however, in two thousand eleven Alberta upped the limit to $Two,000 while Ontario upped the limit in the fall of 2015.

Insurance Company Reporting: Your insurance policy states that you are required to report all accidents, regardless of the amount of harm. Many drivers believe that if they pay the damages themselves they don’t need to involve the insurer; this is not true. Your insurer needs to be kept in the loop of any collision.

Peak: When in an accident that is not your fault, having a dash cam recorder for movie coverage may increase the chances that your insurance company will side with you in case of a claim.

Reporting an Accident: No injuries and damages exceed your province’s threshold

Police Reporting: By law, you are required to report an accident if the harm exceeds your province’s limit (Alberta and Ontario’s is $Two,000). In other words, if you’re an Ontario resident and one vehicle sustains $1000 in estimated damages and the other vehicle is dinged for $1001 in damages, you are required to report it to the police or a Collision Reporting Centre.

Failing to report an accident to the police when it’s required by law means you are running the risk of being charged with leaving the scene. Leaving the scene of a collision is a serious conviction that could result in a hefty increase to your car insurance rates, fines, and even jail time.

Insurance Company Reporting: You are required to report all collisions to your auto insurance company. If you don’t report it, and the other driver does, their insurance company could contact yours in the process of lodging the claim. If it is determined that you were partially or wholly at-fault for the collision—even if you paid for the damages yourself—your rates may end up reflecting that you were involved in an accident.

What about collisions that occur on private property, like parking lots?

For the most part, a parking lot accident is no different than a collision that occurs while driving on the street, road or highway. The police will need to be notified if there are injuries, or if there are damages that exceed your province’s threshold. And, even tho’ it may be private property, you need to notify your insurer if you’re involved in a collision.

Scripts when reporting an accident is required, no matter what the value of property harm

There are times when you must, by law, report a collision to the police no matter how much—or little—property harm has been sustained, like when the collision involves:

  • Injury (no matter how minor) or death
  • A criminal act like impaired driving
  • A government vehicle (Federal, Provincial or Municipal)
  • A vehicle that is transporting dangerous goods
  • Uninsured or unlicensed drivers
  • Harm to private, municipal or highway property (think a homeowner’s lawn, telephone pole or guard rail)
  • Pedestrians or bicyclists

And, like all other collisions, a call to your insurance provider is required in order to make sure you’re covered in the event of a claim.

Was in a MINOR fender bender on Friday. The car in front of me had a green light, commenced to stir then slammed her violates on. I had some time to stop but did TOUCH her bumper. A day later her byfriend called to say the bumper was Cracked! There is no harm to my car at all, and the night of there was no harm. The bf told me he desired $630 cash to fix it, and also said he got a quote from a bod shop in town. Earlier this afternoon I was in the outer left lane turning onto the cross street by my house. I embarked my turn on yellow and before I was finished it was crimson. Since you didn’t actually collide with anyone and you seem jumpy about this situation, you could go to your local police station and notify them that someone impersonating a police officer followed you and let them know the situation.

Typically if one driver reports the accident to his insurer, the other drivers insurer will be notified. I’m not sure if the other driver agreed not to go through insurance or not… I would suggest speaking with him. Typically, the driver who hits from behind is at fault. I would suggest you take a look through the IBC’s (Insurance Bureau of Canada) fault determination rules as this is what the claims adjusters will use as a guideline when conducting an investigation of fault for accidents. You can find out from your parents broker/your broker what your policy coverage details are. Sometimes there is an “accident forgiveness” endorsement added to coverage. If this is the case for your policy, your very first accident will not increase your rate.

Hi, my question is if someone accuse you of scraping their car while backing out of a parking spot and you know you did not hit it but they called the cops; and now it’s a he said – she said issue; and it was reported to the police but they issued a non-reportable report. Does the insurance company have to be notifiied. There is a scrape on this persons car and they were attempting to say it was me….and it wasn’t. BTW, looking at the scrape it could be touched out with a cloth. I don’t know if this person needed a scapegoat when telling their dad that the BMW had a scrape on it. I don’t think this person will even pick up the report from the police station. I think they indeed just needed a reason to tell their dad there was a scrape on his car.

I infrequent hit someone in the 1st week of July two thousand thirteen in Toronto Canada. hi. i backed into a parked car that was on the road, right behind my driveway. it happened on a wednesday. I didnt expect the damages to be more than 800. i gave my info and said i’d pay it out of pocket as the harm was minimal. looking back, it would have been clever to take pictures. a long weekend happened and i hadn’t heard from them until the tuesday, where the very first quote is about 1900. I’m going to call my insurance company tomorrow to notify them of the accident. am i going to get reemed out for waiting so long? how much more do you see my insurance going up? I’ve been driving ten years and three years with the current insurance provider, no accidents or tickets.

Often times an endorsement is added to a policy called accident forgiveness… if you have this with your current provider and have been claims free, you might be saved a rate increase. A driver backed into me in a parking lot. I followed him into the parking lot from the main street. He was driving down the aisle looking for a parking spot and braked abruptly when he noticed an empty spot to his left. When he stopped, I stopped. Hello, a few weeks ago my bf was driving my van, and got sideswiped by a car attempting to get over in the other lane, and somehow missed my big crimson van. My vehicle was parked legally in the parking lot where I Iive. Then a female moving into my building hit it with a truck causing harm to it.

her all the decent paperwork, police report etc. But then she emailed me back

& said that there was nothing she could do until she talked to the driver.

This was a month ago & obviously the dame that hit me is attempting to

This morning I was driving down the highway. There was an accident to my right, and I had seen the ambulance before and gotten into the left palm lane in prep. IF you ” did not collect any information from each other” then chances are neither of you can file a decent collision report so I would suspect that for both of you this accident never occurred.

I was hit by a taxi driver who crossed a solid yellow line on a residential street attempting to race past me while I was making a left turn. He hit the front driver side quarter of my car with his front right quarter. I went to the reporting centre and did the reporting thing and while getting a sympathetic ear from the officer when it came time to get the fix done the adjuster called it no fault. This was a clear case of the taxi driver making an illegal pass on a clearly marked street and driving prompt enough to cause considerable harm to my car.

No matter what I said to the adjuster he insisted that it was a 50/50 script. The pictures of the harm clearly display that it was not and the road was a no passing zone that he hit me in.

I am disturbed by the adjuster’s attitude which struck me as it was not worth fighting for as my cars book value was below write off value. I had the car immovable after taking the insurance money and adding extra money to get it stationary.

My wifey stopped at a crimson light on a uphill slope and was front-ended by a car that stopped in front of her. The driver of that car was very apologetic and suggested moving to the nearest parking lot for information exchange. My wifey reported the accident to our insurance company and provided all data in regards to the party at fault. In several days our insurance company informed her that the 2nd party blamed her for the accident (rear-ending).

You have two separated issues in here. Very first, when she was blocking you in, you should have told her to stir, amicably. I don’t think she would deny. Next, if she turn down. Why? You could give her five minutes. If she still reject, call the police and run right into her car. What she had done was committing a criminal offence – illegal confinement. In the process, make sure you have gathered enough evidence to prove your case.

You were at fault but the ‘victim’ went away. What more can you ask for? At times, some experienced drivers, based on the feel of the influence that the vehicle did not sustain significant harm or maybe the bump was not in such a good form anyways, so they don’t care as much. You were so fortunate they did pull a prompt on you.

A car was backing up at a Mcdonald’s drive thru..swift enough I thought he was going to hit my car,so I reversed not realizing a pick up truck was behind me. I hit her front bumper causing dent to her licensed plate. She asked me my driver’s license and name with phone number and told me she was going to call me the next day to let me know if there’s further harm because it’s hard to see at the time it was around eight pm. She told me that if she doesn’t call until noon the following day it means there’s no issues. What if both parties didn’t report a minor accident to the collision centre within forty eight hours. Would the driver at fault be still responsible for any cost of damages to the other party? No exchanges of insurance involved, just names and phone numbers.. Thanks!!

I am an insurance agent and deal with these types of questions daily. It doesn’t matter why you backed up. If you backed into another vehicle you are at fault. If you do not have claims forgiveness your rates will increase. Normally you will pay a 70% surcharge. This surcharge will come down only a little bit each year. You will proceed to be surcharged for six years after this collision. Even if you do not contact your insurance company, the other person may. Do the math. If you think the other man is attempting to scam you, I say that’s too bad. Consider the alternative. Again do the math. Why should the other man live with a scrape on his bumper … it wasn’t his fault. If he was driving a old car with lots of dings, yea he’s going to put the money in his pocket. Again consider the alternative. Pay to paint his bumper that you may or may not have scraped. Then suggest to buy him dinner at the Keg. You will save thousands. If you have claims forgiveness, then you have a decision to make. Do you want to use up your one freebie for such a puny amount of cash. Don’t get caught up in “He’s tearing you off” You messed up. it is a plain as that. Again I say “Do the math”.

Technically you are supposed to report an accident to your insurance as soon as you can. The reason you gave is understandable. The other party said they wished to pay. You waited and now it shows up they are not willing to pay for damages. Go ahead and call them. In Ontario your own insurance company pays anyway. It does not affect your insurance rate if your parked car is hit by a third party. If you identify the person, you do not have to pay your deductible.

The most significant part of this issue is that the other person is driving without insurance. This is a very serious offence and you should do your part and help getting this driver off the road. It is up to a $Five,000.00 fine and from what I have seen, this is the amount the court sets even for the very first offence. I hope I have helped.

Its too late for you Bob but I would like to comment in order to help someone else in this type of situation. If you are hit by someone else and they admit fault. Have them write a note at the time or record them admitting it on your brainy phone. If they turn down, then call the police. Attempt to get the names and phone numbers of someone who witnessed the incident. A person who is at fault is remorseful when face to face to with you, but once they leave and talk to their spouse friends or whoever and begin thinking about the consequences, they now embark thinking about how to wiggle off the hook. Get a written or recorded statement at the scene.

I think most people would agree with you that the accident was the taxi drivers mistake and was due to his carelessness and impatience. I am an insurance agent and agree with you. HOWEVER, your insurance company is correct. In fact they have actually helped you out by finding fault at 50/50. Most accident scripts are covered in “Fault Determination Rules” and in your case as much as it deepthroats, Fault is with you. Here’s why. Basically the other vehicle has the right to overtake you he has switched lanes to pass and then you turned entered the lane turning left in front of them. Almost the same as turning left into the lane of an on-coming vehicle. Who the heck looks into their mirror when turning left into a driveway. it is unfortunate but it is the way it works. Just like the person who is waiting to turn left and the light turns yellow. Looks like everyone is stopping so you proceed. Someone not paying attention to the yellow proceeds through the light and hits you. You were at fault for turning into the path of the dummy who ran the yellow. Here’s another one to very careful of. You want to pull out onto a road and turn left. someone stops and waives you out. maybe its three lanes broad, A truck stops in the 2nd lane for you and waives you out. someone is approaching the back of the stopped truck and comes in the third lane to pass it. Guess what, you just entered that lane and get hit. Your fault! Just be aware of these potential issues. It doesn’t matter if the police charge you or not… its your fault.

50% at fault is the same as 100% at fault. There may be some insurance companies who do not rate (charge extra) for a 25% at fault accident, but they will be few and far inbetween. So if you are partially to blame, Expect to pay more.

I am not sure if you are in Ontario or not. This reaction is basically the same no matter which province you are in. In Ontario we have what is called ” No Fault Insurance” what that mean is that your insurance company pays to fix your car or cover minor individual injuries no matter who’s fault the accident was. So the other person should call their insurance to have and damages repaired. The person who is not at fault will not have their premiums increase nor do they have to pay for any collision deductible when their car is immobilized. If the you are in another province, you still don’t have to pay for the other guys vehicle repairs if you are at fault. Their insurance will fix their car and collect from your insurance company if you are at fault. This is called subrigation. ( Not sure if I spelled that decently) Again i’m not sure if there are other issues around this accident because you mentioned waiting for a police report. I will guess that you both are blaming each other for the accident. if this is the case, if one of you does not have collision coverage’s your insurance company will not authorize the repair of the vehicle until fault can be determined.

Same thing just happened to me. Except it was in a stop light the lady got all mad after she witnessed that nothing happened to her car or mine. So she asked for my insurance and my drivers licenses to write down information. While she was doing that a cop passed by and asked if everything was okay, the lady said yes and the cop left. When do you report an accident, when don’t you, and what are the consequences? Below are some valuable guidelines to help you know what to do if you get in a collision.

  • Recently been involved in a collision? Compare car insurance rates to see if you can pay less for your coverage.

Reporting an Accident: No injuries and damages are within your province’s threshold

Police Reporting: Each province sets a dollar value for estimated damages that will determine if you need to involve the police. In Alberta and Ontario, for example, the threshold is $Two,000. What’s this mean? You are not required to report an accident to the police if the total harm is less than that outlined by the province. This limit includes the harm to both vehicles.

  • The limit in Ontario and Alberta used to be $1,000; however, in two thousand eleven Alberta upped the limit to $Two,000 while Ontario upped the limit in the fall of 2015.

Insurance Company Reporting: Your insurance policy states that you are required to report all accidents, regardless of the amount of harm. Many drivers believe that if they pay the damages themselves they don’t need to involve the insurer; this is not true. Your insurer needs to be kept in the loop of any collision.

Peak: When in an accident that is not your fault, having a dash cam recorder for movie coverage may increase the chances that your insurance company will side with you in case of a claim.

Reporting an Accident: No injuries and damages exceed your province’s threshold

Police Reporting: By law, you are required to report an accident if the harm exceeds your province’s limit (Alberta and Ontario’s is $Two,000). In other words, if you’re an Ontario resident and one vehicle sustains $1000 in estimated damages and the other vehicle is dinged for $1001 in damages, you are required to report it to the police or a Collision Reporting Centre.

Failing to report an accident to the police when it’s required by law means you are running the risk of being charged with leaving the scene. Leaving the scene of a collision is a serious conviction that could result in a hefty increase to your car insurance rates, fines, and even jail time.

Insurance Company Reporting: You are required to report all collisions to your auto insurance company. If you don’t report it, and the other driver does, their insurance company could contact yours in the process of lodging the claim. If it is determined that you were partially or wholly at-fault for the collision—even if you paid for the damages yourself—your rates may end up reflecting that you were involved in an accident.

What about collisions that occur on private property, like parking lots?

For the most part, a parking lot accident is no different than a collision that occurs while driving on the street, road or highway. The police will need to be notified if there are injuries, or if there are damages that exceed your province’s threshold. And, even tho’ it may be private property, you need to notify your insurer if you’re involved in a collision.

Scripts when reporting an accident is required, no matter what the value of property harm

There are times when you must, by law, report a collision to the police no matter how much—or little—property harm has been sustained, like when the collision involves:

  • Injury (no matter how minor) or death
  • A criminal act like impaired driving
  • A government vehicle (Federal, Provincial or Municipal)
  • A vehicle that is transporting dangerous goods
  • Uninsured or unlicensed drivers
  • Harm to private, municipal or highway property (think a homeowner’s lawn, telephone pole or guard rail)
  • Pedestrians or bicyclists

And, like all other collisions, a call to your insurance provider is required in order to make sure you’re covered in the event of a claim.

Was in a MINOR fender bender on Friday. The car in front of me had a green light, began to stir then slammed her violates on. I had some time to stop but did TOUCH her bumper. A day later her byfriend called to say the bumper was Cracked! There is no harm to my car at all, and the night of there was no harm. The bf told me he desired $630 cash to fix it, and also said he got a quote from a assets shop in town. Earlier this afternoon I was in the outer left lane turning onto the cross street by my house. I embarked my turn on yellow and before I was finished it was crimson. Since you didn’t actually collide with anyone and you seem jumpy about this situation, you could go to your local police station and notify them that someone impersonating a police officer followed you and let them know the situation.

Typically if one driver reports the accident to his insurer, the other drivers insurer will be notified. I’m not sure if the other driver agreed not to go through insurance or not… I would suggest speaking with him. Typically, the driver who hits from behind is at fault. I would suggest you take a look through the IBC’s (Insurance Bureau of Canada) fault determination rules as this is what the claims adjusters will use as a guideline when conducting an investigation of fault for accidents. You can find out from your parents broker/your broker what your policy coverage details are. Sometimes there is an “accident forgiveness” endorsement added to coverage. If this is the case for your policy, your very first accident will not increase your rate.

Hi, my question is if someone accuse you of scraping their car while backing out of a parking spot and you know you did not hit it but they called the cops; and now it’s a he said – she said issue; and it was reported to the police but they issued a non-reportable report. Does the insurance company have to be notifiied. There is a scrape on this persons car and they were attempting to say it was me….and it wasn’t. BTW, looking at the scrape it could be pawed out with a cloth. I don’t know if this person needed a scapegoat when telling their dad that the BMW had a scrape on it. I don’t think this person will even pick up the report from the police station. I think they truly just needed a reason to tell their dad there was a scrape on his car.

They got an estimate of one thousand two hundred which is unlikely, the car is worth very likely one thousand itself! Were worried they may claim but is a claim worth it in this case? In Ontario, you must report an accident if you harm property. so if the guardrail was bruised then you should report it.

Most of the time regardless of the reason, the driver who rear-ends the vehicle in front is considered to be at fault.

This morning I was driving down the highway. There was an accident to my right, and I had seen the ambulance before and gotten into the left palm lane in prep. What right to have to see what ticket the other driver received. I received a ticket after being hit at the rear of my vehicle during a turn. My car was side swiped when someone in his truck came from behind and pulled out in front of me to go into a drive thru. I was driving past the parking lot to the drive thru, if he would have waited five seconds it would have been his turn. Hello, My friend backed into somones car at a crimson light (she was over the crosswalk, so she reversed and didnt see the car behind her). Obviously she is at fault, the only harm apparent on the person’s car who she hit was chipped paint, which was acknowledged by both parties. They exchanged info. Two weeks later the person is claiming that she needs the grill, bumper and bondage mask immobilized. My friend went to the reporting centre to see if a the collision was reported, it turns out the collision was not reported. What are my friends rights in this situation, she doesnt have photos, but she does have exchanged text with the other driver in which she says she doesnt see any harm on the car.

I was in an accident which I think I wasn’t at fault about three years ago. No charges were laid but the other driver and myself were found 50% at fault according to the insurances. I was hit by a taxi driver who crossed a solid yellow line on a residential street attempting to race past me while I was making a left turn. He hit the front driver side quarter of my car with his front right quarter. I went to the reporting centre and did the reporting thing and while getting a sympathetic ear from the officer when it came time to get the fix done the adjuster called it no fault. This was a clear case of the taxi driver making an illegal pass on a clearly marked street and driving rapid enough to cause considerable harm to my car.

No matter what I said to the adjuster he insisted that it was a 50/50 script. The pictures of the harm clearly display that it was not and the road was a no passing zone that he hit me in.

I am disturbed by the adjuster’s attitude which struck me as it was not worth fighting for as my cars book value was below write off value. I had the car stationary after taking the insurance money and adding extra money to get it motionless.

My wifey stopped at a crimson light on a uphill slope and was front-ended by a car that stopped in front of her. The driver of that car was very apologetic and suggested moving to the nearest parking lot for information exchange. My wifey reported the accident to our insurance company and provided all data in regards to the party at fault. In several days our insurance company informed her that the 2nd party blamed her for the accident (rear-ending).

You have two separated issues in here. Very first, when she was blocking you in, you should have told her to stir, amicably. I don’t think she would reject. Next, if she reject. Why? You could give her five minutes. If she still reject, call the police and run right into her car. What she had done was committing a criminal offence – illegal confinement. In the process, make sure you have gathered enough evidence to prove your case.

You were at fault but the ‘victim’ went away. What more can you ask for? At times, some experienced drivers, based on the feel of the influence that the vehicle did not sustain significant harm or maybe the bump was not in such a good form anyways, so they don’t care as much. What if my car was bruised by falling pinecones on private property where I was told and coerced to park against my wishes due to the fear of harm to my vehicle from the falling pine cones. A car was backing up at a Mcdonald’s drive thru..prompt enough I thought he was going to hit my car,so I reversed not realizing a pick up truck was behind me. I hit her front bumper causing dent to her licensed plate. She asked me my driver’s license and name with phone number and told me she was going to call me the next day to let me know if there’s further harm because it’s hard to see at the time it was around eight pm. She told me that if she doesn’t call until noon the following day it means there’s no issues. The next day, sure enough she called and said she just noticed that her front bumper shifted a little bit. What’s are legal responsibilities? Should I report this but it’s Good Friday. Or should I wait for her estimates.. I’m just worried she is just after the money.. She sounds so suspicious. But it was just a minor harm. Please help.. What if both parties didn’t report a minor accident to the collision centre within forty eight hours. Would the driver at fault be still responsible for any cost of damages to the other party? No exchanges of insurance involved, just names and phone numbers.. Thanks!!

I am an insurance agent and deal with these types of questions daily. It doesn’t matter why you backed up. If you backed into another vehicle you are at fault. If you do not have claims forgiveness your rates will increase. Normally you will pay a 70% surcharge. This surcharge will come down only a little bit each year. You will proceed to be surcharged for six years after this collision. Even if you do not contact your insurance company, the other person may. Do the math. If you think the other dude is attempting to scam you, I say that’s too bad. Consider the alternative. Again do the math. Why should the other stud live with a scrape on his bumper … it wasn’t his fault. If he was driving a old car with lots of dings, yea he’s going to put the money in his pocket. Again consider the alternative. Pay to paint his bumper that you may or may not have scraped. Then suggest to buy him dinner at the Keg. You will save thousands. If you have claims forgiveness, then you have a decision to make. Do you want to use up your one freebie for such a petite amount of cash. Don’t get caught up in “He’s tearing you off” You messed up. it is a elementary as that. Again I say “Do the math”.

Technically you are supposed to report an accident to your insurance as soon as you can. The reason you gave is understandable. The other party said they desired to pay. You waited and now it emerges they are not willing to pay for damages. Go ahead and call them. In Ontario your own insurance company pays anyway. It does not affect your insurance rate if your parked car is hit by a third party. If you identify the person, you do not have to pay your deductible.

The most significant part of this issue is that the other person is driving without insurance. This is a very serious offence and you should do your part and help getting this driver off the road. It is up to a $Five,000.00 fine and from what I have seen, this is the amount the court sets even for the very first offence. I hope I have helped.

Its too late for you Bob but I would like to comment in order to help someone else in this type of situation. If you are hit by someone else and they admit fault. Have them write a note at the time or record them admitting it on your brainy phone. If they turn down, then call the police. Attempt to get the names and phone numbers of someone who witnessed the incident. A person who is at fault is remorseful when face to face to with you, but once they leave and talk to their spouse friends or whoever and begin thinking about the consequences, they now commence thinking about how to wiggle off the hook. Get a written or recorded statement at the scene.

I think most people would agree with you that the accident was the taxi drivers mistake and was due to his carelessness and impatience. I am an insurance agent and agree with you. HOWEVER, your insurance company is correct. In fact they have actually helped you out by finding fault at 50/50. Basically the other vehicle has the right to overtake you he has switched lanes to pass and then you turned entered the lane turning left in front of them. Almost the same as turning left into the lane of an on-coming vehicle. Who the heck looks into their mirror when turning left into a driveway. it is unfortunate but it is the way it works. Just like the person who is waiting to turn left and the light turns yellow. Looks like everyone is stopping so you proceed. Someone not paying attention to the yellow proceeds through the light and hits you. You were at fault for turning into the path of the dummy who ran the yellow. Here’s another one to very careful of. You want to pull out onto a road and turn left. someone stops and waives you out. maybe its three lanes broad, A truck stops in the 2nd lane for you and waives you out. someone is approaching the back of the stopped truck and comes in the third lane to pass it. Guess what, you just entered that lane and get hit. Your fault! Just be aware of these potential issues. It doesn’t matter if the police charge you or not… its your fault.

50% at fault is the same as 100% at fault. There may be some insurance companies who do not rate (charge extra) for a 25% at fault accident, but they will be few and far inbetween. So if you are partially to blame, Expect to pay more.

I am not sure if you are in Ontario or not. This response is basically the same no matter which province you are in. In Ontario we have what is called ” No Fault Insurance” what that mean is that your insurance company pays to fix your car or cover minor individual injuries no matter who’s fault the accident was. So the other person should call their insurance to have and damages repaired. If the you are in another province, you still don’t have to pay for the other guys vehicle repairs if you are at fault. Their insurance will fix their car and collect from your insurance company if you are at fault. This is called subrigation. ( Not sure if I spelled that decently) Again i’m not sure if there are other issues around this accident because you mentioned waiting for a police report. I will guess that you both are blaming each other for the accident. if this is the case, if one of you does not have collision coverage’s your insurance company will not authorize the repair of the vehicle until fault can be determined.

Same thing just happened to me. Except it was in a stop light the lady got all mad after she spotted that nothing happened to her car or mine. When do you report an accident, when don’t you, and what are the consequences? Below are some valuable guidelines to help you know what to do if you get in a collision.

  • Recently been involved in a collision? Compare car insurance rates to see if you can pay less for your coverage.

Reporting an Accident: No injuries and damages are within your province’s threshold

Police Reporting: Each province sets a dollar value for estimated damages that will determine if you need to involve the police. In Alberta and Ontario, for example, the threshold is $Two,000. What’s this mean? You are not required to report an accident to the police if the total harm is less than that outlined by the province. This limit includes the harm to both vehicles.

  • The limit in Ontario and Alberta used to be $1,000; however, in two thousand eleven Alberta upped the limit to $Two,000 while Ontario upped the limit in the fall of 2015.

Insurance Company Reporting: Your insurance policy states that you are required to report all accidents, regardless of the amount of harm. Many drivers believe that if they pay the damages themselves they don’t need to involve the insurer; this is not true. Your insurer needs to be kept in the loop of any collision.

Earlier this afternoon I was in the outer left lane turning onto the cross street by my house. I commenced my turn on yellow and before I was finished it was crimson. I’m not sure if the other driver agreed not to go through insurance or not… I would suggest speaking with him. Typically, the driver who hits from behind is at fault. I would suggest you take a look through the IBC’s (Insurance Bureau of Canada) fault determination rules as this is what the claims adjusters will use as a guideline when conducting an investigation of fault for accidents. You can find out from your parents broker/your broker what your policy coverage details are. Sometimes there is an “accident forgiveness” endorsement added to coverage. If this is the case for your policy, your very first accident will not increase your rate.

Hi, my question is if someone accuse you of scraping their car while backing out of a parking spot and you know you did not hit it but they called the cops; and now it’s a he said – she said issue; and it was reported to the police but they issued a non-reportable report. Does the insurance company have to be notifiied. There is a scrape on this persons car and they were attempting to say it was me….and it wasn’t. BTW, looking at the scrape it could be fondled out with a cloth. I don’t know if this person needed a scapegoat when telling their dad that the BMW had a scrape on it. A driver backed into me in a parking lot. I followed him into the parking lot from the main street. verify the details & he got the true story out of them. That my neighbor was

driving, not the truck holder.

Two days later I hadn’t heard from them so I went to my neighbors door. She was pissed that I had gone to the police but I told her I was covering myself in this. She

then admitted that SHE was driving, not her friend. And that she had no money so

they determined to go through insurance.

Completes up we have the same insurance company. I told my broker & they gave me an adjuster to phone. I called him & he said that because it was the other parties fault, I was given a different adjuster.

I eventually got a hold of the other adjuster & gave

her all the decent paperwork, police report etc. But then she emailed me back

& said that there was nothing she could do until she talked to the driver.

This was a month ago & obviously the damsel that hit me is attempting to

hide hoping this will fade away. I haven’t seen her around the building but she

still lives here as I asked the manager.

This dame is a LIAR & manipulator & is attempting to get out of this.. This would have been a hit & run if my neighbor hadn’t seen them do it.

Most of the time the driver who is making the left turn is considered to be at fault.

My car was side swiped when someone in his truck came from behind and pulled out in front of me to go into a drive thru. I was driving past the parking lot to the drive thru, if he would have waited five seconds it would have been his turn. He got out of his vehicle and asked me to pull forward to a clear spot to exchange information. He gave me his name and cell phone number and I gave him mine as well, he also said that it was his company’s truck, then he told me to get an estimate and get back to him so I said ok. It wasn’t until later that I learned that I should have gotten his insurance and driver’s license. I got the estimate which was around $1900, and when i called to tell him, he said that was pretty expensive for something he considered both of our fault. He said he was going to contact his HSE manager and call the police to file a report. His HSE manager called me and said that after their “investigation” they determined that I was at fault and would not cover the harm. I called my insurance company to report the incident and have been waiting for the adjustor to do their investigation, I know this isn’t my fault and I feel like I’m being bullied by this company. My friends are telling me to contact the manager of the company and to file a police report myself. In Alberta, a report does not have to be made if the harm is under $2000 and it’s been a duo of weeks now. Can I make a report still and would it even make a difference?

As I was driving down the highway to work, this is during morning traffic (6-7am), I was rear ended while slowing down as that was the flow of traffic (picking up then slowing down). I had a safe distance from the driver ahead of me, but the lady claimed I slowed down too quick. Obviously that’s what you do when you’re not attempting to rear end somebody. Last night I was headed to a family friends house I was driving down his street and when I came near his house I had noticed I had just slightly passed his house as the area was dark. I then reversed not realizing there was a car behind me and I had just tapped his car lightly. I checked his car and my car for harm there was minimal harm a minor scrape to both our cars that could lightly be buffed out. He desired insurance information claiming it was his friends car at very first then telling it was his parents car, however I preferred not to go through insurance and determined we would lodge it with some cash. We didn’t exchange any information other than license plate numbers as he was leaving he mentioned that he would give the money to his parents and if it was not enough he has my license plate numbers. So I am not sure what that means if he does go to a collision center how would I know if he did?

IF you ” did not collect any information from each other” then chances are neither of you can file a decent collision report so I would suspect that for both of you this accident never occurred.

Your friend is covered under your insurance while you let him drive your vehicle.

Having said that, typically the left turning driver is at fault so you can relieve 😉

They will have a hard time proving that the harm they want to report after four months is originated by your hitting their vehicle. Deny responsibility in this example. The cargo of proof is on them now.

IF you don’t have any contact information for the other driver and he seemed hesitant, you can play it safe and go report it anyway to the collision centre.

If you think that the harm to BOTH cars is under $1000, no reporting is required.

Hello, My friend backed into somones car at a crimson light (she was over the crosswalk, so she reversed and didnt see the car behind her). Obviously she is at fault, the only harm apparent on the person’s car who she hit was chipped paint, which was acknowledged by both parties. They exchanged info. Two weeks later the person is claiming that she needs the grill, bumper and rubber hood stationary. My friend went to the reporting centre to see if a the collision was reported, it turns out the collision was not reported. What are my friends rights in this situation, she doesnt have photos, but she does have exchanged text with the other driver in which she says she doesnt see any harm on the car.

i got into a car accident four weeks ago, we dont have a police report but I call the insurance. The unsurance knows about the accident. The insurance told me that someone is going to contact me to take pictures of my car, and also they say that they were going to send me some documents that I need to response them and send them back. I hit a car in a parking lot and scraped the rear bumper of that car, no dents. the boy got two quotes of around. $1300 each, which I think is high. My car has minimal harm so I am not going to fix it. Should I go through insurance? He indeed does not want me to go through insurance, will it affect his? How badly will my rates go up? I was in an accident which I think I wasn’t at fault about three years ago. No charges were laid but the other driver and myself were found 50% at fault according to the insurances. I was hit by a taxi driver who crossed a solid yellow line on a residential street attempting to race past me while I was making a left turn. He hit the front driver side quarter of my car with his front right quarter. I went to the reporting centre and did the reporting thing and while getting a sympathetic ear from the officer when it came time to get the fix done the adjuster called it no fault. This was a clear case of the taxi driver making an illegal pass on a clearly marked street and driving swift enough to cause considerable harm to my car.

No matter what I said to the adjuster he insisted that it was a 50/50 script. The pictures of the harm clearly showcase that it was not and the road was a no passing zone that he hit me in.

I am disturbed by the adjuster’s attitude which struck me as it was not worth fighting for as my cars book value was below write off value. I had the car stationary after taking the insurance money and adding extra money to get it immobile.

Why is it that just making the process go quick is what happened rather than do the right thing when the information clearly demonstrated how this accident happened ?

My wifey stopped at a crimson light on a uphill slope and was front-ended by a car that stopped in front of her. The driver of that car was very apologetic and suggested moving to the nearest parking lot for information exchange. My wifey reported the accident to our insurance company and provided all data in regards to the party at fault. In several days our insurance company informed her that the 2nd party blamed her for the accident (rear-ending).

As a result we paid half of the deductible for the repair an d my wifey’s driving record was blemished. So, don’t be gullible, people. And, by the way, can we complain to any agency and release the name of this liar? Any comments are appreciated.

You have two separated issues in here. Very first, when she was blocking you in, you should have told her to budge, amicably. I don’t think she would deny. Next, if she reject. Why? You could give her five minutes. If she still deny, call the police and run right into her car. What she had done was committing a criminal offence – illegal confinement. In the process, make sure you have gathered enough evidence to prove your case.

You were at fault but the ‘victim’ went away. What more can you ask for? At times, some experienced drivers, based on the feel of the influence that the vehicle did not sustain significant harm or maybe the bump was not in such a good form anyways, so they don’t care as much. You were so fortunate they did pull a swift on you.

About a week ago I was hit at a parking lot by a Co worker he was uninsured and we agreed he would pay for damages. It’s been a week and no switch. Can I still report it to my insurance?

We all have a lesson to learn. If that person had alcohol in his breath, regardless, call the police. This is not hard-hearted, if he continued driving under the same condition, someone might get hurt.

Let’s make this very clear. A driver has an absolute responsibility no to hit anything in the line of traveling. Please do not point finger telling the one stops in front of you has no reason to, your responsibility is to keep safety stopping distance and look out.

What if my car was bruised by falling pinecones on private property where I was told and compelled to park against my wishes due to the fear of harm to my vehicle from the falling pine cones. Estimated bruised caused was three thousand five hundred dollars. Should the person responsible for the private property cover the damages or am I out of luck.

This is my story where I work I was in a rush getting there i park yeah, the way I parked it was a little out the line, this was on a Tuesday, now its Friday and they said “i hit a car” let me refresh my memory i know i didn’t hit a car scrape a car or anything, what i want to know before i go to HR is why are they telling me something now if it happened days ago. A car was backing up at a Mcdonald’s drive thru..rapid enough I thought he was going to hit my car,so I reversed not realizing a pick up truck was behind me. I hit her front bumper causing dent to her licensed plate. She asked me my driver’s license and name with phone number and told me she was going to call me the next day to let me know if there’s further harm because it’s hard to see at the time it was around eight pm. She told me that if she doesn’t call until noon the following day it means there’s no issues. The next day, sure enough she called and said she just noticed that her front bumper shifted a little bit. What’s are legal responsibilities? Should I report this but it’s Good Friday. Or should I wait for her estimates.. I’m just worried she is just after the money.. She sounds so suspicious. But it was just a minor harm. Please help.. This is my very first time..nit sure what to do. Thanks

What if both parties didn’t report a minor accident to the collision centre within forty eight hours. Would the driver at fault be still responsible for any cost of damages to the other party? No exchanges of insurance involved, just names and phone numbers.. Thanks!!

I am an insurance agent and deal with these types of questions daily. It doesn’t matter why you backed up. If you backed into another vehicle you are at fault. If you do not have claims forgiveness your rates will increase. Normally you will pay a 70% surcharge. This surcharge will come down only a little bit each year. You will proceed to be surcharged for six years after this collision. Even if you do not contact your insurance company, the other person may. Do the math. If you think the other man is attempting to scam you, I say that’s too bad. Consider the alternative. Again do the math. Why should the other man live with a scrape on his bumper … it wasn’t his fault. If he was driving a old car with lots of dings, yea he’s going to put the money in his pocket. Again consider the alternative. Pay to paint his bumper that you may or may not have scraped. Then suggest to buy him dinner at the Keg. You will save thousands. If you have claims forgiveness, then you have a decision to make. Do you want to use up your one freebie for such a petite amount of cash. Don’t get caught up in “He’s tearing you off” You messed up. it is a ordinary as that. Again I say “Do the math”.

I am an insurance agent and reaction these questions daily. Yes you can still report this to your insurance company. Technically you are supposed to report an accident to your insurance as soon as you can. The reason you gave is understandable. The other party said they dreamed to pay. You waited and now it emerges they are not willing to pay for damages. Go ahead and call them. In Ontario your own insurance company pays anyway. It does not affect your insurance rate if your parked car is hit by a third party. If you identify the person, you do not have to pay your deductible.

The most significant part of this issue is that the other person is driving without insurance. This is a very serious offence and you should do your part and help getting this driver off the road. It is up to a $Five,000.00 fine and from what I have seen, this is the amount the court sets even for the very first offence. I hope I have helped.

Its too late for you Bob but I would like to comment in order to help someone else in this type of situation. If you are hit by someone else and they admit fault. Have them write a note at the time or record them admitting it on your clever phone. If they turn down, then call the police. Attempt to get the names and phone numbers of someone who witnessed the incident. A person who is at fault is remorseful when face to face to with you, but once they leave and talk to their spouse friends or whoever and commence thinking about the consequences, they now begin thinking about how to wiggle off the hook. Get a written or recorded statement at the scene.

I think most people would agree with you that the accident was the taxi drivers mistake and was due to his carelessness and impatience. I am an insurance agent and agree with you. HOWEVER, your insurance company is correct. In fact they have actually helped you out by finding fault at 50/50. Most accident screenplays are covered in “Fault Determination Rules” and in your case as much as it deepthroats, Fault is with you. Here’s why. Basically the other vehicle has the right to overtake you he has switched lanes to pass and then you turned entered the lane turning left in front of them. Almost the same as turning left into the lane of an on-coming vehicle. Who the heck looks into their mirror when turning left into a driveway. it is unfortunate but it is the way it works. Just like the person who is waiting to turn left and the light turns yellow. Looks like everyone is stopping so you proceed. Someone not paying attention to the yellow proceeds through the light and hits you. You were at fault for turning into the path of the dummy who ran the yellow. Here’s another one to very careful of. You want to pull out onto a road and turn left. someone stops and waives you out. maybe its three lanes broad, A truck stops in the 2nd lane for you and waives you out. someone is approaching the back of the stopped truck and comes in the third lane to pass it. Guess what, you just entered that lane and get hit. Your fault! Just be aware of these potential issues. It doesn’t matter if the police charge you or not… its your fault.

50% at fault is the same as 100% at fault. There may be some insurance companies who do not rate (charge extra) for a 25% at fault accident, but they will be few and far inbetween. So if you are partially to blame, Expect to pay more.

I am not sure if you are in Ontario or not. This reaction is basically the same no matter which province you are in. In Ontario we have what is called ” No Fault Insurance” what that mean is that your insurance company pays to fix your car or cover minor private injuries no matter who’s fault the accident was. So the other person should call their insurance to have and damages repaired. The person who is not at fault will not have their premiums increase nor do they have to pay for any collision deductible when their car is motionless. If the you are in another province, you still don’t have to pay for the other guys vehicle repairs if you are at fault. Their insurance will fix their car and collect from your insurance company if you are at fault. This is called subrigation. ( Not sure if I spelled that decently) Again i’m not sure if there are other issues around this accident because you mentioned waiting for a police report. I will guess that you both are blaming each other for the accident. if this is the case, if one of you does not have collision coverage’s your insurance company will not authorize the repair of the vehicle until fault can be determined.

Same thing just happened to me. Except it was in a stop light the lady got all mad after she eyed that nothing happened to her car or mine. So she asked for my insurance and my drivers licenses to write down information. While she was doing that a cop passed by and asked if everything was okay, the lady said yes and the cop left. So i asked the lady is it necessary for me to call the insurance as well, and she said yes, but i don’t see why i should call if she’s the one who is going to call.

Traffic was bad the car in front me slammed on her violates by the time I spotted her break light it was to late for me to stop….I stepped on my brakes to avoid an accident but didn’t work my front bumper was bruised and scrapes on her car police came and I had to tow my truck because the bumper got stuck to my tire. The lady didn’t ask for my insurance or anything since nothing major happened to her car after two weeks she know wants to make a claim to her insurance I received a letter and my name is missed spelled….I have no idea what to do because she never asked me for my details or anything. She most likely got a copy of the police report and got my address but name is misspelled….should I go ahead a contact my insurance
